Judge to rule today in trial of Salmon Arm police officer

A provincial court judge will rule at 2 p.m. whether the Crown has provided enough evidence to support a dangerous driving charge.

The ruling of Provincial Court Judge Anne Wallace this afternoon is being anxiously awaited by those connected with the trial of Const. Micah Chan.

At 2 p.m. Judge Wallace will present her ruling in Salmon Arm on an 'insufficient evidence' motion put forward by defence lawyer Neville McDougall.

Chan, a Salmon Arm police officer, is charged with dangerous driving in connection with an incident on June 20, 2013. He was following Courtney Eggen, 21, of Cherryville, who died after the vehicle she was driving crashed into a parked dump truck.

The defence motion contends that the Crown has not presented enough evidence to support the charge.
